Welcome to Ridez Equestrian Centre. By enrolling in our riding lessons, you acknowledge that you have read, understood, and agreed to the following Terms and Conditions, which govern your participation in our riding lessons in accordance with the laws of the State of Queensland and the federal laws of Australia. If you do not agree with these Terms and Conditions, please do not enrol in our riding lessons.
1. Rider's Responsibility
1.1. All riders must abide by the rules and regulations of Ridez Equestrian Centre, including but not limited to wearing appropriate riding attire, following instructions from our instructors and staff, and treating our horses and facilities with respect.
1.2. Riders must disclose any medical conditions, disabilities, or allergies that may affect their ability to safely participate in riding lessons. Ridez Equestrian Centre reserves the right to refuse participation in lessons if it is determined that it may pose a risk to the rider's health or safety.
1.3. Riders must have a level of physical fitness and ability appropriate for the type of riding lessons they are enrolling in, as determined by Ridez Equestrian Centre. Riders should consult with their physician before enrolling in riding lessons if they have any concerns about their health or fitness.
2. Liability and Waiver of Liability
2.1. Horseback riding is a potentially dangerous activity that carries inherent risks, including but not limited to falls, injuries, accidents and even death. Riders voluntarily assume all risks associated with participating in riding lessons at Ridez Equestrian Centre.
2.2. Ridez Equestrian Centre, its owners, instructors, staff, and volunteers shall not be liable for any injury, loss, or damage suffered by riders, their property, or any third parties, arising from or in connection with the participation in riding lessons, to the fullest extent permitted by law.
2.3. Riders, or their legal guardians if under 18 years of age, are required to sign a liability waiver before participating in riding lessons, releasing Ridez Equestrian Centre from any and all liability for injuries or damages incurred during the lesson or while on the premises.
3. Booking and Payment
3.1. All bookings for riding lessons must be made in advance by contacting us directly. Lessons are subject to availability and may require a deposit or full payment at the time of booking.
3.2. Cancellations made by the rider must be made in writing or by contacting Ridez Equestrian Centre directly. Cancellation fees may apply, and will be outlined at the time of booking.
3.3. Payment for riding lessons must be made in full prior to the start of the lesson unless otherwise arranged with Ridez Equestrian Centre. Failure to make payment may result in the cancellation of the lesson.
3.4. Payments are non-refundable- make up sessions can be arranged if a session is missed (T&C apply)
4. Privacy
4.1. Ridez Equestrian Centre collects and stores personal information of riders in accordance with applicable privacy laws. This information may be used for the purpose of administering riding lessons and communicating with riders about our services.
4.2. Riders may request access to their personal information held by Ridez Equestrian Centre and may request for any inaccuracies to be corrected, in accordance with applicable privacy laws.
5. Intellectual Property
5.1. The content on Ridez Equestrian Centre's website, including but not limited to logos, trademarks, text, images, and videos, are the intellectual property of Ridez Equestrian Centre and are protected by copyright and other intellectual property laws.
5.2. Riders may not reproduce, modify, distribute, or use any of the content on Ridez Equestrian Centre's website without prior written consent from Ridez Equestrian Centre.
6. Confidentiality
6.1. Riders may have access to confidential information during their participation in the riding lessons, including but not limited to trade secrets, training techniques, and business practices of Ridez Equestrian Centre.
6.2. Riders agree to keep all confidential information disclosed during the riding lessons confidential and not to disclose or use such information for any purpose other than their participation in riding lessons.
7. Personal Protective Equipment Requirement
7.1 We recommend an Australian-approved helmet be worn whilst riding. The helmet must be properly fitted using a chin strap and any helmets that have had a significant impact which has compromised the efficacy of the helmet, must not be worn. Helmets are recommended to be less than 5 years old from the date of manufacture.
7.2 Appropriately heeled and soled riding boots (smooth sole) must be worn at all times. The Rider is responsible for having the appropriate footwear to participate in riding activities.
7.3 Clothing must be appropriate to weather conditions and it is recommended to wear long pants and sun-safe attire.
8. Instructor Discretion
8.1 At any time it is at the absolute discretion of the Instructor at Ridez Equestrian Centre to:
- Revoke its approval for the rider(s) and horse(s) to attend or participate in an activity
- Adjust and change gear on horse(s) during an appointment time if the instructor feels necessary
- Adjust/advice to change horses diet if felt necessary by the instructor/owner (Agistment)
- Advise/refer equine health practitioners such as Chiro/farrier/vet visits if necessary (Agistment or use of own horse)
Acknowledgement and Decleration
I declare
- I will accept and follow reasonable directions from the Instructor
I am aware that activities involving horses can be dangerous and unpredictable and that I can be injured or killed. I accept all risks of personal injury, death or property damage to myself or caused to others.
I am aware that I may be personally liable for injury or damage to others' horses, people or property that is caused by myself or my horse(s)
I release, discharge and promise not to sue for any loss, damage, injury, including death, or cost to me or my child(ren) arising out of the handling, riding, or being close proximity to a horse, on the premises, when handling, riding a horse, using of saddles, bridles, equipment or gear provided by me or by RIDEZ ECAR.
I understand that a horse's natural instincts are to jump forward or sideways, to run away from danger at a trot, or canter, or gallop, to kick, to buck, to rear up in front, to pigroot or to bite. I understand that helmets, safety equipment, proficiency checks, supervision and/or enforcement of rules DO NOT AND CANNOT GUARANTEE my or my child(ren)'s safety. I understand these risks and voluntarily assume these risks and dangers for myself or on behalf of my child(ren) or legal ward.
I acknowledge that Horseback riding, handling animals or being close proximity to animals is an inherently dangerous activity and involves risks that may cause serious injury and in some cases death, because of the unpredictable nature and irrational behaviour of animals, regardless of their temperament, training or past performance.
- I have fully read and understand the TERMS AND CONDITIONS on this form and I AGREE that all Terms and Conditions are included in the Agreement between myself and RIDEZ ECAR .
Riding defined: when the client is sitting on the back of a horse in a saddle or bareback and personally controls the movements of the horse with the bridle & reins or is on the lunge/leadline, sitting on the horse in a saddle or bareback while being controlled or commanded by the instructor on the ground or on a horse.
Riding helmets: I understand that I can better protect myself against head injuries by wearing protective equestrian head gear while mounting, riding, dismounting and around horses. Helmet failure is out of the hands of RIDEZ ECAR and I Accept full responsibility for checking the helmet is in accordance with Australian standards as well as the increased risk of injury if I decide not to wear a helmet or not require my child(ren) or legal ward to wear a helmet.
Protective Gear and Apparel; I have been advised to wear protective footwear at all times while grooming, riding, and tacking up the horse AND wear a helmet while riding. It is understood that RIDEZ ECAR is not responsible for securing the helmet on the rider's head at all times.
I hereby authorize & consent to the following medical treatment for said minor. I understand that as a participant/parent/guardian, I will be responsible for the costs of any services or treatments necessary/ advised.
Liability Release: I understand that I am responsible for bodily injury or property damage that I or my child(ren) or legal ward should sustain while riding a horse provided by RIDEZ ECAR or provided by me (own horse/ agistee horse ) may it be in a lesson/ clinic/ club/ agistment, try out, lease and or for free. I am also responsible for medical expenses or any other expenses incurred as a result of such bodily injury or property damage. I am responsible for any time I, or my child(ren) or legal ward shall lose in employment or school or other activity. I hereby for myself, my heirs, administrators and assigned release and discharge RIDEZ ECAR, the instructors and all of their officers, employees and volunteers from claims, demands, actions, and cause of action for such injuries /death sustained to my person, or that of my child(ren) or legal ward, other third party and/ or my/ any property.
I agree to indemnify and pay any expenses, loss or damage that is incurred by RIDEZ ECAR and all of their officers, employees and or volunteers arising out of my, my child(ren) or legal wards' participation in any RIDEZ ECAR related or sponsored activity as well as riding on RIDEZ ECAR property ground and/or off the property on my horse, Ridez ECAR provided horse or a horse of my own choosing of RIDEZ ECAR for free or with payment to Ridez ECAR or from an agistee.
INDEMNITY/LIABILITY RELEASE BY PARENT OR GUARDIAN OF MINOR CHILD OR LEGAL WARD
In the knowledge that a parent by law cannot waive the personal injury rights or other claims of a (their) minor child(ren) or legal ward, the undersigned parent or guardian of said minor child(ren) or legal ward agrees to indemnify RIDEZ ECAR and all of their officers, employees or volunteers from any financial loss suffered as a result of any claim brought on behalf of said minor child(ren) or legal ward. Further, I agree not to bring any claim or other legal action against RIDEZ ECAR and all of their officers, employees or volunteers for personal injuries/ death suffered by said minor alleging negligent act or acts of omission by RIDEZ ECAR and all their officers and employees.
